Terms of Service

These terms govern your access to and use of D&E Property Pro.

1. Agreement

By creating an account or using D&E Property Pro ("the Service"), operated by D&E Property Pro ("we", "us"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. The Service

The Service provides property intelligence tools, document analysis, and inspector-led workflows for the Australian market. Outputs are informational and do not constitute legal, financial, building, engineering, or valuation advice. You remain responsible for independent due diligence and professional advice.

3. Accounts

You must provide accurate registration information and keep credentials secure. You are responsible for activity under your account. We may suspend or terminate accounts that violate these terms or pose security or abuse risk.

4. Acceptable use

  • Use the Service only for lawful purposes and in compliance with applicable Australian laws.
  • Do not attempt to bypass access controls, quotas, billing, or security measures.
  • Do not upload unlawful, infringing, or malicious content.
  • Do not scrape, reverse engineer, or resell the Service except as expressly permitted.

5. User content

You retain ownership of documents and images you upload. You grant us a limited licence to store, process, and display that content solely to operate and improve the Service. You represent that you have the rights to submit content and that doing so does not violate third-party rights.

6. Paid features

Certain features require payment. Prices, billing intervals, and refund treatment are shown at checkout or in product documentation. Subscriptions renew according to the plan selected unless cancelled in accordance with displayed terms.

7. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Automated analysis and AI-assisted wording may contain errors; verify critical information independently.

8. Limitation of liability

To the maximum extent permitted by Australian Consumer Law and other applicable law, our aggregate liability arising from the Service is limited to the greater of (a) amounts you paid us in the twelve months before the claim or (b) AUD $100. We are not liable for indirect, consequential, or lost-profit damages.

9. Privacy

Our collection and use of personal information is described in our Privacy Policy.

10. Changes

We may update these terms by posting a revised version with a new version number and last-updated date. Material changes may require renewed acceptance where required by law or product design.

11. Governing law

These terms are governed by the laws of Victoria, Australia. Courts in Victoria have non-exclusive jurisdiction, subject to mandatory consumer protections that cannot be excluded.
